Mason Mugshot Expungement Timing

Expungement is not the same as release. Under West Virginia Code §61-11-25, a qualifying acquittal or dismissal petition may be filed in the circuit court where the charge was filed no sooner than 60 days later. The statute's defined records expressly include arrest records, fingerprints, and photographs. A granted order directs courts and agencies to handle those records as the law provides.

For a potentially qualifying conviction, §61-11-26 measures the waiting period from the latest of conviction, completion of incarceration, or completion of supervision. The general periods stated in the research are one year for one qualifying misdemeanor, two years for multiple qualifying misdemeanors, and five years for a qualifying nonviolent felony. Many offenses and situations are excluded, so those periods never promise eligibility.

The actual Mason County release date and any later parole or probation discharge date therefore matter to the filing timeline. A granted order reaches public electronic entries and agency records as the statute directs. The order should be sent to each lawful custodian or publisher holding a copy.
